1 SALES AND DELIVERY TERMS

1.1

These Sales and Delivery Terms apply to the purchase of goods and services on madklubben.dk for delivery in Denmark, excluding Greenland and the Faroe Islands.

 

1.2

By using the website madklubben.dk or making a purchase on madklubben.dk, you accept to be bound by these Sales and Delivery Terms. If you do not wish to be subject to these Sales and Delivery Terms, you should immediately leave the website madklubben.dk. Please note that errors in printing, typing, sold-out products, and minor discrepancies between written descriptions and displayed images are reserved.

 

2 PROVIDER

2.1

The provider is: Madklubben Catering ApS, CVR 29 61 97 07, Smedeholm 15, 2730 Herlev, phone: (+45) 33 42 42 65 / (+45) 33 32 32 34.

 

3 AGREEMENT

3.1

You select the food, beverages, and access to events ('Goods and Services') you wish to purchase by adding them to your digital shopping cart on the website. You can view, edit, and delete the selected Goods and Services in your shopping cart until the moment you click 'complete payment.' You will be asked to accept these Sales and Delivery Terms.

 

3.2

No binding agreement is entered between us until you have received an order confirmation from us at the email address you provided when placing the order.

 

3.3

You must be at least 18 years old to purchase alcoholic beverages.

 

3.4

When purchasing catering, you accept these terms and conditions until the date we deliver, or you collect your order. You can edit your order in your digital shopping cart until the editing deadline specified in the cart, typically 4 days before the delivery date, but no later than December 11, 2024, if it concerns the New Year's menu. Thus, you may also edit the final price of the order until the delivery takes place. Until your order is collected or delivered, Madklubben may send information to the provided email, as you have consented to this during the ordering process. If you no longer wish to receive news and offers from the Madklubben group, you can withdraw your consent after the delivery of your order. The agreement terminates on the same date as your order is delivered. If you wish to terminate the agreement, we refer to the general terms described in section 11 and our customer service.

 

4 DESCRIPTIONS OF THE GOODS AND SERVICES YOU CAN PURCHASE

4.1

On Madklubben's webshop madklubben.dk, you can purchase season-specific catering menus consisting of food and optional drinks, as well as access to special events, collectively referred to as 'Goods and Services.'

 

4.2

The Goods and Services you can purchase are described in more detail on the specific page on madklubben.dk where you select the Goods and Services to be added to your shopping cart.

 

4.3

If you have any questions about your Goods and Services or the expected delivery or pickup time, you can contact us at derhjemme@madklubben.dk or nytaar@madklubben.dk if your order is for New Years Eve. .

 

5 PAYMENT

5.1

We accept the following payment cards: Dankort, Dankort/Visa, Mastercard, Maestro, Visa, Visa/Electron, and JCB. Additionally, you can pay with Mobile Pay.

 

5.2

The payment transaction is handled by an approved payment service provider.

 

5.3

A fee may be charged for payments with certain credit cards, equivalent to the fee charged by the card issuer, if Madklubben is entitled to do so under applicable law. The fee will be indicated when selecting the payment method.

 

5.4

Upon receiving your order, the purchase price must be paid in advance for date-specific catering and events. Therefore, we will deduct the full purchase price for catering, events, and similar items immediately after sending the order confirmation to your email address.

 

6 PRICE AND COSTS

6.1

All prices on madklubben.dk are inclusive of VAT. In addition, you must pay any shipping costs, which will be indicated on the order page before you are asked to click 'complete payment.' Unless otherwise stated on the order page, no other costs or fees will be charged, except for the above-mentioned shipping costs and fees for payment using credit and debit cards.

 

6.2

You can always see a summary of the total purchase price and shipping costs in your shopping cart before clicking 'complete payment.' Any card payment fees are disclosed when selecting the payment card.

 

7 DELIVERY

7.1

The delivery location and time for the delivery of Goods and Services are specified when you place your order.

 

7.2

Delivery is deemed to have taken place when your Goods and Services, in accordance with our agreement, are made available at the agreed delivery address. If you have specified in your order that your Goods and Services can be placed at the front door or another location if you are not at home, delivery is deemed to have taken place when your Goods and Services are made available at that location.

 

7.3

Tickets for events are sent only by email to the email address you provided.

 

7.4

Events are delivered on the date and time specified at the time of ordering.

 

7.5

If you have questions about the delivery, you can contact us at derhjemme@madklubben.dk or nytaar@madklubben.dk regarding orders for New Years Eve.

 

7.6

Shipping costs for Goods and Services sent by a carrier may vary depending on the nature of the ordered Goods and Services and your delivery address. The actual shipping costs are always provided in connection with your order.

 

7.7

Goods and Services are delivered to the Copenhagen area. If we cannot deliver to the desired delivery address, you will be notified during the ordering process.

 

7.8

Goods and Services are generally delivered by a carrier.

 

8 CANCELLATION

8.1

For catering orders, cancellations must be made in writing to derhjemme@madklubben.dk, and the cancellation must be received by us at least 5 full business days before the agreed delivery time. Upon cancellation, you will receive a confirmation that the cancellation has been received.

 

Up to 5 full business days before the agreed delivery time, you can also amend your order in writing by sending an email to derhjemme@madklubben.dk.

 

If you have placed your order four days or fewer before your event, we are unable to make changes to your order or refund your purchase.

 

If the order is refused on the agreed delivery date, the full price for the entire order will be charged.

 

8.2

Special conditions apply to catering for New Year's Eve.

If you wish to cancel your purchase of New Year's catering, you can cancel and receive a refund until December 11, 2024, at 12:00 PM. After this date, it is not possible to cancel your purchase or receive a refund. However, it is possible to transfer your purchase to another recipient.

 

After December 11, 2024, you cannot make changes or add covers to your existing order. If you wish to add more covers, you must order them in a new order.

 

If you have ordered delivery for your New Year's menu, it is not possible to change this in the order afterwards. If you regret choosing delivery, you will need to cancel your original order and then make a new purchase, selecting pickup instead. The same applies if you initially chose to pick up the New Year's menu but later change your mind—you must cancel your original order and then make a new purchase where you select delivery.

9 CANCELLATIONS OF EVENTS

9.1

We reserve the right to cancel advertised events, for example, due to insufficient registrations or the illness of key personnel. In the event of cancellation on our part, you will have the option to either (1) transfer your registration to another available event or (2) receive a refund of the payment made. However, we do not guarantee that canceled events will be rescheduled later.

 

10 FORCE MAJEURE

10.1

We are not responsible if a delay or non-delivery is due to force majeure.

 

11 RIGHTS OF WITHDRAWAL

11.1

Under the Consumer Contracts Act, consumers generally have the right to withdraw their online purchases without giving a reason within a period of 14 days.

 

11.2

The withdrawal period of 14 days is usually calculated from the day the consumer physically receives the goods.

 

11.3

However, many of the Goods and Services we sell are exempt from the right of withdrawal. Generally, this includes:

 

Food, beverages, or other goods for household consumption delivered to your home, residence, or workplace,

Fresh food, including refrigerated goods, and other goods likely to deteriorate or expire quickly,

Groceries and canned goods, as well as other goods delivered sealed for health and hygiene reasons, where the seal/packaging has been broken,

Delivery of alcoholic beverages, where the price was set at the time of the purchase agreement, and delivery can only take place after 30 days, and where the actual value depends on market conditions beyond our control,

Leisure services, including events and cooking classes, where it is specified in the agreement on which date or within a specific period the service will be performed. This includes the purchase and sale of New Year's menus. Certain events or cooking classes may be scheduled to take place before the expiration of the withdrawal period.

 

12 EXERCISING THE RIGHT OF WITHDRAWAL

12.1

If you have the right of withdrawal and wish to exercise it, you must notify us - Madklubben Derhjemme ApS, Smedeholm 15, 2730 Herlev, derhjemme@madklubben.dk - of your decision to withdraw from this agreement in an unequivocal statement (e.g., via email).

 

12.2

You may choose to use this standard withdrawal form www.retsinformation.dk/Forms/R0710.aspx?id=160666#Bil3, but it is not mandatory.

 

12.3

If you have the right of withdrawal, the withdrawal period will be considered met if you send your notice of withdrawal within the withdrawal period.

 

13 CONSEQUENCES OF WITHDRAWING A PURCHASE

13.1

If you have the right of withdrawal and choose to exercise it within the withdrawal period, we will refund all payments we have received from you regarding the withdrawn purchase, including delivery costs (excluding additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered), without undue delay and in any event no later than 14 days from the date we receive your notice that you are exercising the right of withdrawal. See below for further details on the withdrawal of goods purchases.

 

13.2

We will carry out such a refund using the same means of payment as you used for the initial transaction, unless you have expressly agreed to a different refund method.

 

13.3

You will not be charged any fees for the refund under any circumstances.

 

14 SPECIFICS REGARDING WITHDRAWAL OF GOODS PURCHASES

14.1

We may withhold the refund until we have received the Goods and Services back from you, which are covered by the withdrawn purchase, or you have provided evidence that you have returned the Goods and Services to us, whichever occurs first.

 

14.2

You must return the Goods and Services to us without undue delay and no later than 14 days from the date you have informed us that you are exercising the right of withdrawal. The deadline is met if you return the Goods and Services before the 14-day period expires. You bear the risk for the Goods and Services until we have received them back.

 

14.3

You must bear the direct costs associated with returning the Goods and Services.

 

14.4

Always contact us before returning wine. We reserve the right to specify a different method of return than postal delivery, at an additional cost.

 

14.5

You are only liable for any depreciation of the ordered Goods and Services resulting from handling other than what is necessary to ascertain the nature, properties, and functioning of the Goods and Services.

 

15 COMPLAINTS REGARDING DEFECTIVE GOODS OR SERVICES

15.1

We always strive to deliver correct and defect-free Goods and Services.

 

15.2

Should you receive a Good or Service that does not meet your expectations, we kindly ask you to contact us as soon as possible at derhjemme@madklubben.dk or by phone so that we can rectify any errors.

 

15.3

There may be cases where we will ask you to return the defective product so that we can examine it and/or return it to our supplier. Therefore, please refrain from discarding defective items or items of poor quality, including the packaging, until you have been in contact with us.

 

15.4

We will cover your return costs.

 

16 COMPLAINTS – GOODS AND SERVICES

16.1

The rules of the Sale of Goods Act apply.

 

16.2

If you wish to complain about a defect, you must notify us within a reasonable time after discovering the defect. Otherwise, you lose the right to invoke the defect. In the case of complaints about food and beverages, please notify us as soon as possible after discovering the defect and no later than 5 days after receipt. Defects will be remedied by replacement or refund of the purchase price.

 

17 COMPLAINTS – EVENTS

17.1

The Sale of Goods Act does not apply to the purchase of event access.

 

17.2

If an event does not meet your expectations, please notify us within a reasonable time and no later than 2 months after the event. Otherwise, you lose the right to invoke any defects in events.

 

18 HOW TO COMPLAIN

18.1

If you wish to complain about a Goods or Service you have purchased from us, we encourage you to contact us in writing, after which we will handle your complaint.

 

18.2

You can also complain to the Center for Dispute Resolution, THE HOUSE OF DISPUTES, Toldboden 2, 8800 Viborg, CVR number: 37795526, klageportalen@naevneneshus.dk. Complaints can also be submitted online at https://naevneneshus.dk/. The right to complain may, in certain cases, be subject to the item or service you wish to complain about costing at least DKK 1,000.

 

18.3

Consumers residing in another EU country can also complain via the EU Commission's online complaint platform: http://ec.europa.eu/odr.

 

19 LIMITATIONS OF LIABILITY

19.1

Madklubben.dk is provided as is. We make no guarantees regarding Madklubben.dk. We do not vouch for the content or accuracy of Madklubben.dk and are not responsible for the deletion or blocking of Madklubben.dk by ourselves or third parties. We are not responsible for the content of links to a third party's website.

 

19.2

Under no circumstances can we be held liable for (i) loss of revenue, loss of business, business opportunities, loss or destruction of data or data recovery, loss of goodwill, security breaches caused by third-party telecommunications and/or the internet, loss of revenue (whether direct, indirect, or consequential), (ii) loss or damage as a result of liability to third parties (both direct, indirect loss, or consequential damage), or (iii) any indirect loss. Our total liability is, in any event, limited to DKK 10,000.

 

19.3

The remedies specified in these Sales and Delivery Terms are the only remedies available to you.

 

20 PERSONAL DATA

20.1

For us to enter into, and fulfill, the agreement with you, we need the following information:

20.2

We collect your personal information for the purpose of delivering the purchased Goods and Services to you, collecting the associated payment, and administering the supplier-customer relationship established between us through your purchase. We may also send you our newsletter if you have given your consent.

The data controller is Madklubben Catering ApS. Detailed contact information can be found at the top of this document.

 

20.4

Please be aware that information you send to us by email or exchange with us through our website is not encrypted.

 

20.5

Information you provide to Madklubben Catering ApS will not be disclosed to third parties unless required by law. However, we may disclose such information in connection with a possible sale of Madklubben Catering ApS' business activities.

 

20.6

You have the right to know what information we have recorded about you. You also have the right to have incorrect registered information corrected and to object to the information being registered. These rights are granted to you under the Data Protection Act. In connection with this, please contact Madklubben ApS at derhjemme@madklubben.dk or by letter.

 

20.7

If you are dissatisfied with our handling of your personal information, you can file a complaint with the Danish Data Protection Agency (https://www.datatilsynet.dk/om-datatilsynet/kontakt/).

 

20.8

Furthermore, the terms of our privacy policy apply.

 

21 CHOICE OF LAW

21.1

These Sales and Delivery Terms are subject to Danish law. The Copenhagen City Court is the exclusive jurisdiction.
